Why should I read this notice?

This notice explains how we at Konsento collect, use and protect your information. You should read it if you are, or want to become a customer.

What information do you collect about me?

Customers: When you sign up for Konsento, we collect your e-mail address and password and organisation name. With your consent, we will use cookies and similar technologies to collect information about your browser and your IP-address. You can find more information about that in the section about cookies below.

Customers: You are responsible for handling information about your data that you enter into Konsento. When you pay for your Konsento subscription, your payment information is collected directly by one of our payment service providers, (Stripe) [https://stripe.com] or (GoCardless)[https://gocardless.com]. We do not have access to your payment information.

How will you use my information?

We use your information to give you access to the Konsento platform and to send you e-mails about changes or technical issues that may affect platform performance. With your consent:

  • We use the information collected by cookies and similar technologies to analyze how you use our platform with the aim to improve our technical support by resolving technical issues faster and more effectively.
  • We e-mail you information about the Konsento service, such as notifying you about new or improved features.
  • We send you reminders, for example when you have not used the service a while.

How long do you keep my information?

Admins: We erase information about how you use our platform on an ongoing basis. We keep this information no longer than 3 years.
Admins: We will erase your information immediately after you cancel your Konsento account.

With whom do you share my information?

Technical service providers
The Konsento platform is built on top of several cloud services. We have to share your information with those services to make Konsento work. These services include:

  • Heroku: The heart of Konsento. Most of your information is processed here.
  • Papertrail: Collects logs, for example system and web logs.
  • Sentry: Collects logs, for example system and web logs.
  • Amazon: Cloud storage. Stores all files that admins upload to Konsento.
  • RedisLabs: Improves system performance by caching popular information.
  • Mailgun: Our e-mail provider. Delivers all e-mails sent from the Konsento platform or its users.
  • Intercom: Real-time chat for support and customer onboarding.

Marketing service providers

With your consent, we share some of your information, mostly usage data that contains as little information as possible about you, with the following marketing services:

  • Google: We use Google Analytics to collect usage statistics for our website. We share your IP-address and device fingerprint.
  • Facebook: We share information about the fact that you are using our website. Facebook uses that information to show you ads. You can hide these ads by changing your Facebook settings
  • Mixpanel: A tool to analyze your usage data. We use it to improve Konsento and to send you automated messages related to Konsento, for example a welcome e-mail that explains how the Konsento interface works.
  • Intercom: We use it as our customer support and onboarding tool.

Where do you keep my information?

We keep your information at one of Amazons’s datacenters near your location. If you are a member of an organization within the EU, your data will reside in one of Amazons’s datacenters in the European Economic Area. For technical reasons, we may transfer your data to countries outside the European Economic Area. When this is the case, we use appropriate safeguards, namely the European Commission’s standard contractual clauses and Privacy Shield.

What about cookies?

Cookies are small text files that websites store in your web browser when you visit them. Our website uses cookies for verifying your identity and remembering your preferences and settings. The table below explains the cookies we use and why.

Which rights do I have?

Access: You can request a copy of the information that we hold about you.
Correction: We want to make sure that your personal information is accurate and up to date. You may ask us to correct or remove information you think is inaccurate.
Erasure: You can demand that we erase your information. We are not allowed to erase information about you that the law requires us to keep.
Data portability: You can ask us to transfer your information from our IT environment to another, either to another company’s or your own. This does not apply to information about you that the law requires us to keep.
Withdrawing consent: You can withdraw your consent for sharing your usage data or receiving marketing information at any time. You can do that by sending an e-mail to support@coachhippo.com.
Complaints: You can lodge a complaint with us or your local data protection authority at any time.

How can I exercise my rights?

Members: If you would like to exercise any of the above rights, please contact your organization. Since your organization is responsible for your information, Konsento needs to have the permission of your organization to help you exercise your rights.
Admins: If you would like to exercise any of the above rights, please email or write to us at the following address. If you would like to lodge a complaint with your local data protection authority, please contact the authority directly.

Changes to this policy

We keep our privacy policy under regular review and we will place any updates on this webpage. This privacy policy was last updated on 2018-02-22.

Terms of Service

1. Definitions

1.1. “Great Minds”, “We,” “Us” or “Our” means Great Minds described in Section 2.

1.2. “Customer”, “You” or “Your” means, in the case of an individual accepting this Agreement on his or her own behalf, such individual, or in the case of an individual accepting this Agreement on behalf of a company or other legal entity, the company or other legal entity for which You are accepting this Agreement.

1.3. “User” means, in the case of an individual accepting these terms on his or her own behalf, such individual. In the case of an individual accepting this Agreement on behalf of a company or other legal entity, “User” means an individual who is authorized by You to use a Service.

1.4. Customer and Great Minds are individually referred to as a “Party” and collectively as the “Parties”.

2. General

2.1. The Konsento platform (“the Service”) is run by Great Minds Studio AB (“We”,”Our”,”Us”,”Great Minds”) a company registered in Sweden under the company number 559046-0605 and the address Eyvind Johnsons gata 12, 112 16 Stockholm.

2.2. The Service allows registered Users to: (i) create and manage one or more organizations online; (ii) give consents to such an organization; or both (i) and (ii). The Service includes communications from Us, such as service announcements and administrative messages.

2.3. This document explains the User Agreement (the “Agreement”) which applies to the Service. By using the Service, You accept the Agreement and agree abide by them. If You do not agree to the Agreement, do not use the Service.

2.4. We reserve the right to update and change the Agreement from time to time without informing You.

4. Data Controller

4.1. The terms of the data processing addendum at https://konsento.io/gdpr/Konsento-DPA.pdf (the “Addendum”) govern how we may process personal data on Your behalf and are hereby incorporated into the Agreement by reference.

4.2. To the extent we process any personal data (as defined in the Addendum) contained in Your data, on Your behalf, in the provision of the Services, the terms of the Addendum shall apply and the Parties agree to comply with such terms.

5. Code of Conduct

5.1 By using the Service, you accept Code of Conduct (available at konsento.io) and agree abide by it.

6. User Conduct

6.1. You must be 18 years or older or have guardian authorization and consent to use the Service.

6.2. In order to use the Service, You must create a password protected User account. You are responsible for maintaining the confidentiality and security of Your password and account. You are fully responsible for all activities that occur under Your account and any other actions taken in connection with it. You must ensure that You exit from Your account at the end of each session. You agree to notify Us immediately in writing of any unauthorized use of Your account or any other security breaches. We will not be liable for any loss or damage from Your failure to comply with this clause.

7. Charges and Payment

7.1. Some of Our plans are only available if You pay for them. The charges for the different plans are shown on the Service and include VAT. You can pay for a plan online by credit card. All Your payments will be processed via 3rd party payment providers and We will not have access to Your credit card or other payment information at any time. The charges will be payable in advance and You can choose whether to pay monthly or annually. We will automatically take payment each month/year (as applicable) and will continue to do so until You advise Us otherwise. You can cancel Your plan at any time via Your account control panel. You can also send Us a cancellation request via email to support@konsento.com.

7.2. If We accidently take payment after You have given Us notice that You no longer wish to pay for a plan, We will refund You in full. If We are unable to collect payment for any reason or You fail to pay the charges, We may suspend the features of the relevant plan until We receive payment in full and in cleared funds.

7.3. You may upgrade or downgrade plans at any time by selecting the plan You want. If You upgrade to a higher plan, the higher plan will be available to You as soon as You have paid the relevant charges. If You downgrade to a lower value plan, You will be charged the lower amount when Your next payment is due.

7.4. We reserve the right to change the charges at any time by giving You not less than 30 days notice.

8. Cancellation and Termination

8.1. If You cancel the Service, Your cancellation will take effect immediately and Your account will be terminated. After cancellation, You will no longer have access to Your account and all information contained therein will be deleted. We accept no liability for such deleted information or content.

8.2. We may, in Our sole discretion, terminate Your password, and/or account, and remove and discard any content within the Service, for any reason, including and without limitation, the lack of use, or if We believe that You have violated the Agreement. We may also, in Our sole discretion and at any time, discontinue providing the Service, or any part thereof, with or without notice.

8.3. You agree that any termination of Your access to the Service under the Agreement may be effected without prior notice, and You acknowledge that We may immediately deactivate or delete Your account and all related information and files. We reserve the right to bar any further access to such files or the Service.

8.4. We will not be liable to You or any third-party for any termination of Your access to the Service.

9. Intellectual Property Rights

9.1. We are the owner or the licensee of all intellectual property rights in the Service, the material published on it, and any necessary software used in connection with the Service ("Software”). These works are protected by copyright laws and treaties around the world. All such rights are reserved. Except as expressly authorized by Us, You agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part.

10. Indemnity

10.1. You agree to indemnify Us from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of Your content, Your use of the Service, Your team member’s activities, Your connection to the Service, Your violation of the Agreement, whether You are a registered User or not. You are solely responsible for Your actions when using the Service, including, but not limited to, costs incurred for Internet access.

10.2. Nothing on the Service Website constitutes advice, nor does the transmission, downloading or sending of any information or the Material create any contractual relationship.

11. Disclaimer

11.1. You understand and agree that Your use of the Service is at Your sole risk. The Service is provided on an "as is" and "as available" basis. We disclaim all warranties of any kind, whether express or implied. We will make reasonable efforts to maintain the Service. However, We are not responsible for any damage, loss of data, customer information or vendor data, revenue, or other harm to business arising out of delays, mis-delivery or non-delivery of information, restriction or loss of access, bugs or other errors, unauthorized use due to Your sharing of access to the Service, or other interaction with the Service. You are responsible for maintaining and backing-up Your data and information that may reside on the Service.

11.2. We do not warrant that: the Service will be uninterrupted, timely, secure, or error-free; the Service will meet Your specific requirements; any errors in the software will be corrected; the results that may be obtained from the use of the Service will be accurate or reliable; and the quality of any products, services, information, or other material purchased or obtained by You through the service will meet Your expectations.

11.3. Any material downloaded or otherwise obtained by using the Service is done at Your own discretion and risk. You will be solely responsible for any damage to Your computer system or loss of data that results from the download of any such material. No advice or information, whether oral or written, obtained through or from the Service shall create any warranty not expressly stated in the Agreement.

11.4. The Service may provide links to other websites or resources. We have no control over such websites and resources. We are not responsible for the availability of such external sites or resources. We do not endorse and are not liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that We shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with use of or reliance on any such content, goods or services available on or through any such website or resource.

12. Limitation of Liability

12.1. We hereby expressly exclude, to the extent permitted by law, all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity; and any liability for any direct, indirect or consequential loss or damage incurred by any User in connection with Our Service or in connection with the use, inability to use, or results of the use of Our Service, any websites linked to it and any materials posted on it, including: loss of data; loss of income or revenue; loss of profits or contracts; loss of anticipated savings; loss of business; wasted management or office time; and loss of goodwill, whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to Your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.

13. Governing law

13.1. These terms are governed by and construed in accordance with Swedish law and You submit to the exclusive jurisdiction of the Swedish courts.

We want everyone who uses the Konsento platform to have a positive and safe experience. By using the Konsento platform, you agree to abide by the following rules:

  • Do not break or help other people to break the law
  • Do not encourage hatred
  • Do not harass, bully or threaten other people nor encourage somebody to do so.
  • Do not upload or share
    1. Other people's personal information without their permission;
    2. Images of people without their consent;
    3. Images or videos of minors without the consent of their parents or guardians;
    4. Sexual or pornographic material
    5. Images that show violence
    6. Content that infringes on copyrights or other proprietary rights; or
    7. any other unlawful or objectionable content.
  • Do not mislead others into believing that you are someone else
  • Do not access another person’s account without their permission.
  • Do not spam. This includes sending any unwanted promotional or commercial content.
  • Do not transmit or distribute malicious code or use the Konsento platform for phishing scams.
  • Do not communicate to others that you are using Konsento without our consent.
  • Interfere with or disrupt the Konsento platform or servers or networks connected to it.

When we believe that someone breaks these rules, we may remove content, disable accounts or take any other action we deem appropriate. When we have reason to believe that someone breaks the law, we will work with law enforcement. If you think that someone does not follow these rules, please send an e-mail to support@konsento.io.
